EMAIL DISTRIBUTION LIST

Alluvium maintains an email distribution list to provide subscribers with quarterly reports and various articles. The intention is to keep interested recipients informed about our financial product and more generally about how we approach investment. Even though we do keep a record of subscribers, we do not (nor do we have the intention to) sell personal data (name and email) collected during the subscription process. We use MailChimp as our marketing automation platform. By submitting the personal information mentioned previously, you acknowledge that the information you provide will be transferred to MailChimp for processing in accordance with their Privacy Policy and Terms of Service available on their website. Of course, any recipient can unsubscribe from this list at any time by clicking the appropriate link on each email they have been sent in the past.

INVESTOR INFORMATION

When you invest in a financial product that is offered by Alluvium, personal information about you is collected and used to establish, administer and manage your investments. Alluvium uses this personal information to maintain a record of your investment details and to communicate with you.

Any information we collect from you may be used by any entity carrying out functions on behalf of Alluvium for:

  • the purpose of enabling Alluvium to provide services or information to you in accordance with our investment management activities;
  • the purposes of enabling Alluvium to undertake research, planning, product development, risk assessment, risk modelling and marketing; and
  • any other purpose to the extent that it is required by law.

This will involve Alluvium disclosing your personal information to:

  • organisations involved in providing investment administration, custody, unit registry and other services (the “Administrator”). The Administrator’s privacy policy is available at: www.mainstreamgroup.com;
  • any joint holder of an investment; and
  • parties to whom you have consented to the disclosure, which may include a licensed financial adviser, dealer group or a service provider.

We will only disclose personal information to entities carrying out functions on behalf of Alluvium on a confidential basis.

The information we collect from you may also be disclosed to third parties to the extent that disclosure is required by law. Alluvium and/or the Administrator uses your personal information to comply with Anti-Money Laundering and Counter Terrorism Financing laws, Australian taxation laws and all other applicable laws; and discloses personal information to various law enforcement agencies, regulatory authorities and governments around the world, including the Australian Taxation Office and the Australian Transaction Reports and Analysis Centre. Alluvium and/or the Administrator may also be required to ask about your tax residency status under taxation information sharing agreements between Australia and other countries. Specifically, under the Foreign Account Tax Compliance Act (a tax treaty between Australia and the United States), and under Common Reporting Standards obligations, Alluvium and/or the Administrator are required to collect additional personal information about US citizens and/or US tax residents who invest in Alluvium’s financial products.

Personal information may also be used for secondary purposes such as for the provision of reporting, promotional and marketing material (from Alluvium and/or the Administrator). Individuals can notify Alluvium at any time if they do not wish to receive such materials or information. Where Alluvium collects your personal information for a specific purpose not contemplated in this Policy, Alluvium will provide you with a collection notice which explains the primary purpose and any related secondary purposes for which your personal information is being collected.

We do not actively seek to collect sensitive information (for example health information or information about any criminal record), unless it is necessary for our business purposes. If we do have to collect sensitive information, we will only collect, use and disclose it in accordance with privacy laws.

Alluvium does not sell, rent or trade personal information to, or with, third parties.

PROTECTION OF PERSONAL INFORMATION

Alluvium takes reasonable steps to preserve the security of personal information it collects.

We have physical, electronic and procedural safeguards to protect your information which is held by us. For example, we do not keep any hard copies of materials containing personal information, and if we were required to do so, they are to be stored in secured office premises. Any electronic files are stored on cloud servers. Both cloud servers and Alluvium email accounts require two-stage authentication and are accessible only to staff whose job purpose requires access. We require all staff to maintain the confidentiality of customer information.

Neither Alluvium nor its service providers can ensure or warrant the security of any information you transmit to us or you receive from us. Once we receive your transmission, we take reasonable steps to preserve the security of information on our own system.

ACCESSING AND UPDATING OF INFORMATION

You can contact us to access the personal information that we hold about you at any time.

If you believe that the personal information we hold is inaccurate, incomplete or out-of-date, you should contact us to correct this information. If we do not agree that the personal information is inaccurate, incomplete or out-of-date, we will notify you in writing of our reasons to refuse any corrections. We will also notify you of what you can do if you are not satisfied with our response.

We will endeavour to promptly update any personal information that is inaccurate, incomplete or out-of-date.
